A marketing and information site for a business-to-business consulting practice. It is intended for business users. It is not intended for consumers or for anyone under 18.
§2 The content is information, not advice
Everything here is general information about what we do. It is not professional advice — not legal, tax, accounting, financial, security or engineering advice — and it is not a recommendation to take any action. Nothing here creates a consulting, advisory or fiduciary relationship. Do not act on it without advice specific to your situation.
Any figures, timelines, savings, examples or results described are illustrative and reflect particular circumstances. They are not a prediction, projection or promise of what you would achieve. Results depend on your systems, data and people.
§3 Booking a call
Booking a call through this site is a request for a conversation. It creates no obligation on either of us, and no commitment to perform work or to any fee. Calls are recorded and transcribed; we say so at the start of every call, and you can decline in advance. See our Privacy Policy.
§4 Acceptable use
Please do not: use the site unlawfully or to break someone else's rights; attempt to gain unauthorised access to it or anything connected to it; probe, scan or test its security; interfere with its operation; scrape or bulk-extract its content; or use automated means to collect information from it other than a well-behaved search-engine crawler.
§5 Consulting services are governed by the contract, not by this page
Nothing on this site forms part of any agreement for services. Consulting services are provided solely under a Statement of Work signed by both parties, and where the documents conflict, the signed Statement of Work governs and these terms have no effect on it. Descriptions of services here are indicative and may change.
§6 Intellectual property
The site and its content — text, layout, graphics, logos and the arrangement of them — belong to Optimize Core or its licensors and are protected by copyright and trade-mark law. You may view it, and quote or link to it with attribution. You may not republish, resell, or use it to train a machine-learning model, or create derivative works from it, without our written permission.
The names Optimize Core and OptimizeCore and our logo are our marks. Other marks mentioned belong to their owners, and mentioning them implies no endorsement in either direction.
§7 Third-party links and services
The site links to and embeds third-party services, including a scheduling tool. Those are operated by others under their own terms and privacy policies, and we are not responsible for them or for their content. A link is not an endorsement.
§8 No warranty
The site is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the site will be uninterrupted, secure, error-free, or that its content is accurate, complete or current. We may change, suspend or discontinue any part of it at any time without notice.
§9 Limitation of liability
To the fullest extent permitted by law, Optimize Core and its owner will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of this site — whatever the theory of liability and even if we were told such damages were possible. Our total liability arising out of or relating to this site will not exceed one hundred US dollars ($100).
This clause does not limit liability that cannot be limited by law, and it does not limit or affect the liability provisions of any signed Statement of Work — those are governed by that document.
§10 Indemnity
You will indemnify and hold harmless Optimize Core and its owner from claims, losses and reasonable legal fees arising from your unlawful use of the site or your breach of these terms.
§11 Governing law and disputes
These terms are governed by the laws of the State of Indiana, without regard to its conflict of laws rules. The state and federal courts having jurisdiction over Madison County, Indiana have exclusive jurisdiction and venue, and you consent to both.
§12 Changes
We may update these terms; the date above will change. Continuing to use the site after a change means you accept the updated terms. Material changes will be flagged on this page.
